DECLARATION OF TRUST
WHEREAS, I, JOSEPH A. NIEHAIIS, of the Lakewood Park Subdivision,
County of St. I,ucie, State of Florida, am the owneir of. certain real
property located at (and known as) I,akewood Park Subdivision. in the
said County of St. I,ucie, State of Florida, which property is describ-
ed more fully in the Deed conveying it from FANNIE T. SEAMAN, the
surviving and unmarried widow of HARRY S. SEAMAN, to JOSEPH A. and
HELEN A. NIEHAUS, as that certain piece or parcel of land with build-
ings thereon standing, located in said St. Lucie County, Florida,
being, ~ .
Lot, 13 Block Unit #1, I,akewood Park Subdivision,
St. Lucie, Florida, as per plat thereof recorded in
Plat Book 10, page 51A of the public records of St.
Lucie County, Florida;
Together with all furniture and furnishings situated
in the home on the premiaes. Said premises are
aub~ect to thoae reservations, reatrictions, and
conditions of public record.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that I do hereby
acknowledge and declare that I hold and will hold said real property
and all right, title and interest in and to said property and all
furniture, fixtures and real and personal property situated therein

Upon my death, unless all the beneficiaries ehall predecease me or
unless we all shall die as a result of a common accident or disaster,
my Successor Trustee is hereby directed Yorthwith to transfer said
property and all right, title and interest in and to said property
unto the beneficiaries absolutely and thereby terminate thie trust;
~ Provided, however, that if any beneficiary hereunder shall then be a
minor, the Succesaor Trustee shall hold the truat assets in continuing
trust until such beneficiary attains the age of twenty-one years.
