HomeMy WebLinkAbout1365 r ~ Lessee, A copy of the~promissory note is attached to this Lease as Exhibit "A" and is incorporated into ~his Lease by this reference th~i-~~.~o T~° L•pssor or its successors or assigns shall retain said funds in accordance with the terms of said note as long as this Lease is in force and until the cessation of the liabilities which ~ the deposit was intended to secure, at which time the Lessor or its ~ successors or assigns are bound to return the security and account therefor•, except as hereinafter provided for, and concurrently with ! such return the Lessee shall surrender the note and it shall be cancelled, Iri the event of default by the Lessee in respect to any of Lessee~s obligations or any of the terms, covenants~ agree- ml3nts or conditions of this Lease by Lessee to be observed or per- ~ formed, the Lessor may use, apply or retain all or any part of said security to cure any such default, or otherwise make itself whole for any damage or expense occasioned thereby, including any damages ~ and expenses or deficier.cies in the reletting ~f the premises, re- ga.rdless whether the accrual of such damage, expenses or defici.encies occurred before or after eviction or summary or other re-entry by the landlord, including, but not Zimited to those that follow: (a) The maintenance of premises and the improvements thereon and return of the Lessor~s property in good condition by the Lessee; (b) The payment of current rentals within the time pro- vi~ded and in the amount provided for by the Lease; (c) The replacement by Lessee of broken, damaged or ; missing personal property and fixtures.
