Provided, however, and it is expressly stipulated,
tinderstood and agreed by the 1Yustee that Parcel B is intended,
at soinetime in the future, to be aet aside and used for median
strip and road right-of-Way purposes as depicted on the sketch
attached hereto and incorporated herein bq reference. Accordingly,
any improvements made by the Trustee, its successors or assigns,
within the ess~ment area shall be done at the sole riak aad ex-
pense of the parties causin~ said improvements to be made. Any
damage or removal, partial or complete, to such improvements
constructed within the easement area resulting from the constru~-

tion of the median strip and access road contemplated by the
parties shall not give rise to any cause of action or right of
recovery on the part of the Trustee, its successors or assigns, ~
who have caused such improvements to be made. Further, any '

additioaal expease incurred by General, iis successors or assigns, ~

in the construction of the proposed median strip and access road
by reason of improvements constructed upon, under, over or within
the easement area shall be the respons.ibility of and borne by the
