DECLARATION OF TRUST
This Declaration of ~ust entered into this the ~
day of ' ~ , 1967, between WILLIAM R. DANNAHOWER, party
of the first part, KENNETH L. PHILLIPS, CODY L. BAILEY and
LUCIA A. DANNAHOWER, parties of the second part, their successors
and assigns.
WITNESSETH: Whereas there has been deeded to the sa~d William
R. Dannahower the property hereinafter described, as trustee
and it is now desired by the said William R. Dannahower to execute
a Declaration of Trust reciting the interests of the parties in
said property and the details and conditions under which the same
shall be held, controlled and disposed of by the said William R.
Dannahower as such trustee. Now, therefore, this Declaration of
Trust.
WITNESSETH: That for and in consideration of the swn of $1Q.00
and other valuable considerations, the receipt of which is hereby
ackn~rledged, the said William R. Dannahower does hereby admit,
acknowledge and declare that he holds as trustee the herein
described real property for the use and benefit of the beneficiaries,
ta.wit: Kenneth L. Phillips, Cody L. Bailey and Lucia A. Dannahower
; said property as follows:

PARK, UNIT 11-A, Plat Book 11, pages 35-37, described
as follows:
~ From the SE corner of the SW~ of the SW~ of Section 12
Township 34 South, Range 39 East, run North along the
Westerly li.ne of said B1ocT~ 16$, 231.20 feet to -the
Point-.of-Begirining; thence continue North 61.32 feet;
thence on a back angle of l~5°0?'S5" (Plat shows
S 45°29'o3nW), run Sou~hwesterly 1~3.26 feet; thence t
run Southwesterly 1+3•1+5 feet, more or less, to the
Point-of-Beginning; '
AND, EXCEPTING THEftEFROM, Easements for Public ftoads

~ Said trustee does further declare that he holds as trustee fvr

and on behalf of the above named beneficiaries whose interest

Said trustee further declares that he has been given full power
and authority in accordance with Florida Statute 1963, 691.03,
including the power to sell, convey, mortgage, assign, lease,
