LUCIE COUNTY, FLORIDA, CLOSING, VACA'I"rNG AND ABANDONING ANY INTEREST OF ST. LUCIE COUNTY AND THE GENERAL PUBLIC IN MARAVILLA BOULEVARD, LYING SOUTH OF THE N.S.L.R.W.¢.D. CANAL NO. :~O AS SHOWN ON PLAT BOOK §, PAGE 1, MARAVILLA HEIGHTS SUBDIVISION, ST. LUCZE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has mode the following determinations: 1. That Sections 177.101,336.09 and 336.10, Florida Statutes, as amended, and Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County may adopt resolutions vacatin9 rights-of-way in whole or in part, which ore under the jurisdiction of the Board of County Commissioners of ,St. Lucie County, Florida. 2. Pursuant to Plat Book 5, Page 1, St. Lucie County and the general public have a dedicated interest in the following described land: THAT PART OF AN UNOPENED 60' RIGHT-OF-WAY KNOWN AS MARAVILLA BOULEVARD LYING SOUTH OF THE N.$.L.R.W.¢. b. CANAL NO. 10 AS SHOWN ON PLAT BOOK 5, PAGE 1, MARAVILLA HEIGHTS SUBDIVISION. 3. Mr. Rosslow owns both sides of the unopened 60' Maravilla Boulevard right-of-way, The abandonment will allow Mr. Rosslow to develop the adjoining lands as one parcel. The od joining lands lie within the corporate city limits of Fort Pierce. This Resolution will be subject to City Council releasing its interest in the abandonment area. A Notice of Intent to Abandon was advertised on July lg and July 26, 2003, and no objections were filed. All abutting property owners have consented to the proposed abandonment. All relevant public utilities have consented to the proposed abandonment. County staff members have reviewed the petition and have filed no objections to the proposed abandonment. 10. 11. 12. On July 15, 2003, the Board of County Commissioners approved Permission to Advertise for o Public Hearin9 on August lf), 2003. On August 1, 2003, letters were moiled to all property owners lyin9 within 300 feet of the proposed abandonment oreo, and no objections were filed. On August 4, ;)003, a Notice of Public Heorin9 was advertised in The Tribune. On August if), ;)003, the Public Hearing was continued to October 7, ;)003. It is in the best interest of the public to vacate and abandon the right-of-way more particularly described os follows: THAT PART OF AN UNOPENED 60' RIGHT-OF-WAY KNOWN A5 MARAVILLA BOULEVARD LYING SOUTH OF THE N.S.L.R.W.C.b. The access connection to Roselawn Boulevard shall be limited to an emergency access as approved by the Driveway Connection Permit issued by the St. Lucia County Road & Bridge Manager. Any revisions to this access connection that would allow for through traffic to use this access connection shall be approved by the St. Lucia County Board of County Commissioners. and the right, title and interest of St. Lucia County and the general public in and to said lands hereby disclaimed and renounced.
