lessor to be performed; at the sole cost and expense of Assignor,
to enforce or secure the performance of each and every oblig,e-
tion, covenant, condition and agreement of said leases by the
lessee to be performed; not to modiPy, extend or in ar~y way alter
the terms of said leases or accept a surrender thereof; not to
anticipate the rents thereunder, or to waive, excuae, condone or
in ar~y manner release or discharge the lessee thereunder of or ~
from the obligations, covenants, conditions and agreements by
said lessee to be performed, including the obligatton to pay the
rental called for thereunder in the me~nner and at the place and
time specified therein, and Assignor doea by these preaenta
express~y release, relinquish and surrender unto the Bank all its
right, power and authority to amend, modify, or in a~y way alter
the terms or provisions of said leases.
2. At Assignor'a sole cost and expense to appear in
-and defend ar~y action or proceeding arising under, growing out
of or in ar~y manner connected with the said leases or the obliga~-
~ tions, duties or 1labilities of the lessor and lessee thereur~der,

f and to pay all coa~$ and expenses of the Bank, includir~g attQt~ey'

fees in a reasonable sum in ar~y action or proceeding concerning
said leases in which the Bank may appear.
3. That shauld the Assignor fail to make a~y payment
or to do_any act as herein provided, the BQnk, but without
obligation so to do and without notice to or demaxid on Asslgnor,
and without releasing Assignor from ar~y obligation hereo~, ma.y
make or do the same 1n auch manner and to such extent as the
Bank may deem neceasary to protect the security hereof, including
specifically, without limiting its general powers, the right to
appear in and defend any actlon or proceeding purporting to
affect the security hereof; or the rights or prnters of the Bank,
ar~d also the right to perform and discharge each and every obli-
gation, covenant and agreement of leasor in said leases containe
