J. ~ 1 ~ sue for or otherwise collect and receive auch rents, issues and profits, including those past due a.nd unpaid, and apply the eame, le$s costs and expenses of operation and collection, including reasonable attorney~s fees, upon any indebtedness secured hereby, _ and in such order as the Bank ma,y determine. The entering upon and taking possession o~ said property ar the collection of ~uch rents, issues and profits and the appl~cation thereof $s afore- ~ said, shall not cure or waive any default or Naive, modiPy or effect notice of default under said mortgage, deed of trust, trust deed or deed to secure debt or invalidate ar~y act done pursuant to such notice. 3. The Bank shall not be obligated to perform or dis- charge, n~r does it hereby undertake to perform or discharge, ar~y obliga.tion, duty or liability under said leasea, or under or by reason of this as$i~nment, and Assignor shall and doe~ hereby - agree to indemnify and to hold the Bank harmless of and fro~n ar~ and all liability, loss or damage which it may or might incur under said lea,ses or under or by reason of this assignment and of and from ar~y and all cla.ims and demends whatsoever which may be asserted against it by rea.son af ar~y alleged vbligationa or under taking on its~ p~t to perPorai or discha,rge ar~y of the terms, covenants or agreements conta.ined in said leases; should the Bank incur ar~y such liability, losa or daa~ge under said leases or under or by reason of this asaignment, or in the defense of any auch claims or demaxids, the amount thereof, including costa, expenses and rea.sonable attorney'a fees, shall be secured hereby, and Assignor shall reimburse the Bank therefor immediately upon demand.
