Before me, the undersigned authority, personally appeared
DONALD M. HORTON, who, upon first being duly sworn did depose and
say that he is a registered land surveyor in the State of Florida, holding
Certificate No. 18?3, and that as auch, he was employed by Robert E,
Rose to survey and subdivide the lands which were conveyed to Robert E.
Rose by deed from Westwoode Manor, Inc,, dated January 2, 1967,
recorded in Official Record Book 16i at page 58, St. Lucie County,
Florida, public records, and by Robert E. Rose and wife conveyed to
~ Briargate Corporation by deed dated January 3, 196?, recorded in Official
f- ,
Record Book 164, at page 59.
That in pursuance of such employment, this Affiant says
that he prepared the Plat of BRIARGATE which is on file in Plat Book
14 at page 19 of the Public Records of St. Lucie County, Florida, but
through an inadvertent omission from the legal description as set forth
on said Plat, such legal description failed to correctly locate the land so
platted, even though such land as reflected by the Plat is shown to be
dimensionally correct; that a true-and correct legal description of the
lands So platted is as follows:
