- BUILDING: ~
(a) Lessor covenants and agrees to erect or cause to be
erected upon the premises, a buiiding designed for and to be used -
for the purpose of conducting and operatiag a gasoline and filliag
.station and automobile service station at a total cost not to ~
exceed the sum of $60,000.00, inciuaive of aii items of expeAditure. -
Cb) Lessee shaii cause to be prepared.and delivered to Lessor
at _its sole cost, within 60 days from the date hereof, complete _
pians and specifications for the construction of said buiiding,
which plans and specif ications shali comply with the building code,
ordinance9, rules and regulations of the City of Port Pie~te, Alorida,
and be approved by Lessor. -
(c) Lessor shali cause const~uction of said building to be
started within 60 days from the date of deliverq of the pians and
specif ications and construction thereof sha11 bs completed, and the
building ready for occupancy within-150 daqs from the date construc-
tion thereof i~ started. ~ -
In the event that the totai cost of constructing said buiiding~
f as provided by the pians and specifications furnished bp Lessee
€ -
~ shall be estimated by Lessor or a building contractor of his choice,

~ to exceed the total su~ of $60,000.00, ttiea and in that eyent said
plans and specif ications shali be mod if ied or cause to be modif ied
by Lessee to the extent and in such manner that the total estimated
cost of construction shaii not exceed the sum of $60,000.00. Or in
lieu thereof, the Lessee shaii have the right and privilege fio
deposit in escrow with the Pirst National Bank at Port Pierce,
P2orida, aii that part of the estimated total cost of constructing
said buiiding exceeding the awa of #60,000.00. The sum so depoaited
