RE: Warranty Deed Prom Charle~ Bolen et ux, et al, to LeRoy
Bolen, dated August 4, 1942, reoorded in Deed Book 111,

STATE OF FLORIDA
COUNTY OF ST. LUCIE ,
Before me, th~ undersigned authority, personally appeared
Charles Bolen who, upon ~irst being duly s~orn, did depoae and
say that the inclusion of Lot 2, of Block 2, of , SERVICE HOME
BUILDERS SIIBDIVISION, as per Plat Book 7, page 17, Public
Records of St. Lucie County, Florida, in the property desoribed
in euc~d sought to be conveyed by the above describeB.Warranty
Deed was in error; that said deed was executed for the purpose
of accomplishing a division among the interested parties of
property that was the sub~ect matter of Chanaery C ase No. 87?E,
lately pending in What Was then the Ninth Judicial Cirouit of
Florida Por St, Lucie County, and as a part of sub3ect suit,
the ~orementioned Lot 2, of Block 2, was aold pursuant to
order of court to David Thomas and Belle Thomas, his wiPe, who
were formerly in possession of said lot and who thereafter
continued in sotual physical poasession of said lot until they
deeded the same to 0. C. Wilcox, a/k/a Ossie Wilcox end Lillie
B. Wilcox, his wife, by deed dated July 16, 1963, recorded in
0. R. Book 67, page 356. .
This a~fiant further says that the said LeRoy Boler_,
grantee in the deed which is the sub~eot of this afPidavit,
never attempted to assert any right, title or interest in the
said Lot 2, Block 2, and was never in possession thereof pr~or
~ to his death whioh occurred on the 22nd day oP ~•'aY , 1967.
