snpply is being determined, the Company and, to the eatent pro• ~
vided in clause (4) of this paragraph, its Transportation Cna-
tomers can reasonably egpect to prodnee for its and their o~rn
acconnt or to purchase at economicaUy practical pricea (whether E
or not the Company or snch Transportation Cnstomers, as the
case may be, has or have a right to prodnce or a contract or otLer =r
right or option to pnrchaae anch gas) for the pnrpose of (i)
transportation tLereof throngh all or any part of the Pipe Line
System and (u) sale or nse of anch gas by the Company, or deliv-
ery of snch gas to or for the account of anch Transportation Cns-
tomers as the owners thereof, as the case may be; provided
however, that in any case where a Tranaportation Castomer is
obligated, snbjeet to force majenre or de min3nais exceptions, -
' to pay 4he Compan~ for the tran~portation of a specified
qnantity of gas ~vbether or not delivered, the entire_ qnantitv
of gas so specified shall be inclnded in a~ailable gas snpply; #
~ (2) the ~`date of eahanation" shall mean the date on which x
s,vailable gas snpply would be eghansted on the assumption that ~
gas from available gas snpply were sold or nsed after the deter-
mination date at an annnal rate eqnal to the aggregate volame ;
of gas transpoi~ted for otheis, sold and used (inclnding gas un-
acconnted for) bp the Companp during the 12 Calendar ~ionths
preceding the determination date;
(3) the factors to be considered, referred to in dause (a) of '
thia paragraph, shall ;nelude (i) the eaistence of proven gas re- #
serves (inclnding gas in solntion or in a common reseivoir with
oil or distillate and to be prodnced with snch oil or distillate in
the form of caeinghead gas), (u) the location of snch reserves in
relation to the Pipe Line System, (iu) the economic deliverabilitp
to the Pipe Line System of gas prodnced from anch reserves, _
(iv) the dedication of any portion of snch reservea to Persons -
(inclnding Transportation Cnstomers or the Company, as the
case may be) other than the Company or Transportation Cnsto- _
mers, ~s the case may be, (v) the effect of any applicable laws,
regulations or orders reqniring the establishment and mainte-
nanee of minimum gas reserves, (vi) the effeet of anp applicable =
