from the Service Company to enhance the value of the property
and for the benefit of the cansumers who will occupy the improv~-

water service purs'uant to the terms of this Agreement;
NOW THSR$FOR13, for and in consideration of the premises,
the mutual undertakings and aqree.~aents herein contained and as-
~ sumed, Developer and Service Company hereby-covenant and agree as

FIRST: Devsloper hereby grant8 and gives to Service Co~n- f
pany, its successors.and assiqns, the exclusive riqht or privi-

lege to const ct or have conatructed, own, maintain and operate
the water fac litiea_necessary to provide one or more water ser- i~
vice connection points a~lonq 8iqhway AlA to aerve the property.
Such pointa are the discharqe side of the water service meter and
hereinafter eametimQS referred to as the "delivery points".
