With respect to the water facilities needed to conne~t the exis- ting water facilities of the Service Canpany to the delivery points alonq 8igliway AlA, initially the Developer shall inatall an eiqht (8) inch water main, together with an appropriate size ser- vice line, meter vault and meter, approximately 1,550 feet ex- tending from the present tenair~a of Service Company'a water main at the Martin-3t..Lucie County line on Highway AlA, north along Sighway AlA to the area of the intersection of Hiqhway AlA and the southern.boundary of the property. Developer aqrees that con- struction will be started within ninety (90) days from the date of t2ais Agre~nent. ' As a contribution in aid-of-construction the Developer . - - hereby aqrees that without further action on the part of the De- veloper that all the water facilities needed to connect the ex- ~ isting water facilitiea of the Service Company to the delivery ~ E points aionq Highway AlA when constructed pursuant to this Agree- ment and connected to the existinq facilitiea of Service Company ~ shall become the sole and exclusive property of Service Company just as if an instrument of conveyance had been executed. The 4 Developer agrees to issue such an instrument of conveyance if re- queated by the Service Company. In addition,~the Developer here- by warranta title to all these facilities aad in this connection the D~valoper agrees to have all partiea construct~ng any of the ~ s , z above deacribed facilities to provide performance and payment . ~ bonde with sufficisnt sureties for the benefit of the Developer and the Service Company.
