finds that:
(1) Service of Process of said Petition and Order to Show Cause
was legaliy had upon 8roward Witliams, State Treasurer and Insurance Cam?ission- ~

er on behalf of the Respondent on September 28, 1967, pursuant to Sections
624.0221 and 624.0222, Florida Statutes, and copy thereof forwarded to Mr.
Thanws A. Harris, 8101 Bisca~yne Boulevard, Miami, Flarida, by Certified Mail,

on September 28, 1967, who had been designated by Respondent as the person
to whom process;against it served upon said Insurance Commissioner was to be
forwarded, which was c~?livered to him on Septeaiber 29, 19b7.• -
-(2j That subsequent to the filing with this Court of said Petition
and the issuance of the Order to Show Cause on Septea~ber 27,1967, the Nonorable
John Norman Harkey,Insurance Ca~missioner for the State of Arkansas, was duiy
appointed by the Washington County Circuit Court of Arkansas on O~taber 2,
1967, Receiver for North American Guaranty Insurance Company, an Arkansas

corporation, for the purpose of rehabilitating said compar~y.
, (~3)~ SectiorF 631~.051 (~1) and (6~, . Florida Statutes, authorizes the
Insurance Comiaissioner to appiy to the Court for an Order appointing him as
Receiver or Mciliary Receiver, and directing him to conserve the assets with-
in this State of a foreign insurer on the grounds that it is impaired or
insolvent, or is found to be in such condition that the furfiher transactfon
of business by it Mili be hazardous ta its policyholders, creditors or stock-
hoiders. . "
(4} Section 631.071, Florida Statutes, au~horizes the Insurance
~ Conmissioner to apply to the Court for an Order appointing him as~ Receiver or
Ancillary Receiver and directing him to conserve the assets in this State of
a foreign insurer on the grour~d that its property has been sequestrated in
~ i ts domi ci l i ary soverei gnty or i n ar~y other soverei gnty.
~5) The Honorable John Nonaan Narkey, Insurance Comnissioner of the
State of Arkansas~ has been appolnted Conservator of North American Guaranty
