WHEREAS one of the aforementioned water control inetallationa - ;
hae been made in connection with a culvert inetallation providing for
the Five Mile Creek flow of water uader State Road No. 70, on the north
eide of said culvert at a point in the NE} of 3ection 19, Towaship 35
3outh of R,ange 39 East; and
~ W~3EREAS City ha8 coaetructed a waterway irom ita pernaanent
reaervoir in the savannah to a point of connection with Five Mile Creek
a short dietance above the laet mentioned water Gontrol inetallation in
the culvert under State Road No. 70 and hae caused to be erected a pump-

~ atatioa for the purpose of enforcing the flow of water out of Rive ~ile ~

, Creek and into the muaicipal water reservoir which action neceseitate8 I
an agreement between District and City governiag the use of water and •
the supervision of the water control installation in Five Mile Creek at
3tate ~toad No. ?0. ~

NOW, THEREFORE, the premise coneidered, it is mutually under-
stood aad agreed ae followa: - ~
1. The control of the flow of water in Five Mile Creek shall con- ~

tinue under the direct supervieioa of Diatrict whoae actione with respect
thereto aball, at all timee, be governed by the beat interests of the land
