IT TS SPECIFICALLY UNDERSTOOD AND AGREED that at those
places where McNEIL ROAll spans a canal, ditch or lateral of the District,
the District reserves the exclusive right to the use of such canal, ditch t
J or lateral, and shall have the duty to operate same in such manner as not '
to interfere with ar otherwise impair the use for which McNEIL ROAD is
designed to serve. IT IS FURTHER UNDERSZ`OOD that the COUNTY hereby
receives the exclusive use and enjoyment of the surface area passing over
the canal, ditch or lateral for which culverts will be duly installed, and
shall have the sole duty to operate and maintain such surface area in such
manner as not to interfere with or otherwise impair the operation of said
canal, ditch or lateral of the District. The last mentioned exclusive use
and enjoyment reserved unto the grantor hereof specifically comprehends

the grantee making adequate provision for the District to gain access to

such waterways (na#ural or artif icial) for the proper maintenance thereof
under all circumstances.
