AGREEMENT
WHEREAS~ EDGAR BROWN and JOSEPHINE BROWN, his wife, parties of
the first part, are the owners of and/or have interest in the S2 ±
~
of Section 17, all of Sections 20, 29, 32, and the E? of Section 31,
~
Township 34 South, Range 39 East, and !

WHEREAS, LESLIE W. SCOTT and MARY SCOTT, his wife, parties of ~
the second part, own or have interest in Sections 5, 8, and the N2 ~
of Section 17, Township 34 South, Range 39 East, and
WHEREAS, there is now a canal and/or drainage ditch running
East and West along the Half Seetion lines of the af oresaid Section
32 and the E? of Section 31, which said drainage ditch attd/or canal
joins with a canal or drainage ditch running North and South along
the East boundary of the N2 of said S~ction 32, the East boundary
of said Section 29, the East boundary of said Section 20, and the
East boundary of the S2 of said Section 17, which said canal turns
Westerly at the NE corner of the S? of said Section 17, and contin~
ues Westerly along the South side of the present Indrio Road, alI
of said canal and/or drainage ditch being within the boundaries of
the parties of the first part, and

~ WHEREAS, the parties of the second part have participated in
the clearing out of said canals and/or drainage ditches and have

~ installed a lock on the property of the parties of the first part
~ ' at a point in Section 32 where the af oresaid East-West canal and/or
~
` drainage ditch connects with the aforesaid North»South canal and/or
~ .
~ drainage d itch, and
~ , it is the desire of the parties hereta to provide f or

~ and allow the parties of the second part to drain through and~or i
~
~ get water from said canals for the drainage and/~r irrigation of i
f ;
~ said Sections 5, 8, and the N? of 17. ~ F
~ NOW, THEREFORE, BE IT AGREED, that for and in consideration of~
- the foregoing, Ten Dollars ($10.00) and other valuable considera•» '

tions, and the covenants herein contained:
~ 1. That the parties of the first part hereby covenant and
- agree, and grant unto the parties of the second part, their heirs ~
