Hernlund husband and wife, being first duly and separately aworn each for himself and heraelf, deposes and says: That they are the identical parties who made, executed and delivered that certain deed to FIRST FEDERAL SAVINGS AND LOAN ASSOCIATIOI~F ~ FORT PIERCE (hereinafter referred to as First Federal), dated the day of , 19 conveying the iollowing deacribed property, to-wit: That part of Govenment Lot 4 of Section 10, Township 35 Seuth, Range 40 East, described as follows; From the point where the North line of Lot 10 of Andrew's and Richard's Resubdivision of part of Tyler's Sub~ division of Lot 4 of Sec. 10, Twp. 35 S, R. 40 E as per plat thereof on file in Plat Book 1, at page 199, of the public records of St. Lucie County, Florida intersects the West line of South Second Street as now laid out in the City of Fort Pierce, run thence southerly on said west line of Second Street 225 feet for point of beginning; thence at right angles to said west line of Sect~nd Street, run Westerly to East line of Florida East Coast Rail- way right of way; thence run Southerly on said east right of way line to the south line of said Section 10; thence east along said south Section line to its point of intereection with the West line of South Second'Street (or its pro- jection); thence run Northerly to Point of Beginning. That the aforesaid deed was an absolute conveyance of the title to said premises to the grantee named therein in effect as well as in form, and was _ and is not intended as a mortgage, trust comreyance, or security of any kind, and that possession of said premises has been surrendered to First Federal, O~~iY O~i~:..ae,.oa fln ~+ti.d a.,., ~f tnl ~ that the consideration for the aforesaid deed is the full canceIIation of all notes, debts, obligations, costs and charges secured by a certain mortgage (in de- ; fault) heretofore existing on the property therein aad hereinbefore described ~ P.XeCUt@d b3? -Tnhn W_ ~TPrr+l»nrl anc~ _F.leannr A_ T~Prnlnnd, hi4 wLfe as mortgagora, to ~ First Federal, as mortgagee, dated the 8th day of October , 19 64 , ~ and recorded in Official Record Book 100 , page _ 14 , of the public re- corde of St. Lucie County, State of Florida, and the release, satis- ~ ~ faction or cancellation of record by First Federal of said mortgage. ~ ~ That the aforesaid deed and conveyance was made by these deponents as the result of their requeat that First Federal accept such deed in extinguishment of their debt and was their free and voluntary act; that at the time of making said deed these deponents believed and still believe that the mortgage indebtedness above mentioned represented the fair value of the property so deeded; that said deed was not given as a preference against any other creditora of the deponents or either of them; that at the time it was given there was no other person, firm or corporation, other than First Federal Savings and Loan Association of Fort ~ Pierce interested, either directly or indirectly in said premises; that these ~ deponents have no other creditora whose rights would be prejudiced by such ~ conveyance, and that deponents are not obligated upon any debt whereby any ~ lien has been created or exi.sts against the premises described in said deed; and that deponents in offering to execute the aforesaid deed to the grantee there- , ' in, and in executing same, were not acting under any duress, undue influence, : misapprehension or misrepresentation by First Federal or the agent or attorney or any other repreaentative of Fir~t Federal, and that it was the intention of these deponeats as grantors in said deed to convey and by said deed theae de- ponents did convey to the grantee therein all their right, title, and interest abeolutely in and to the premises deacribed in esid deed. _ . ~B~DK~~~ ~P#!~ ~1d : - _ . ~ ~ _ ~L~~r" n'~~° .
