That the aforesaid deed and conveyance made by theae depoaents is
executed and delivered with the expresa understanding that its receipt by the .
grantee does not constitute legal delivery and shall be of no binding force
and eifect whatsoever until auch time as the Asid deed and the release, satis-
faction or cancellation of the lien of said mortgage ~are filed for record in the
recorder's office of the county in which the property is eituated, at which
time the fiill legal and equitable title shall vest in the grantee, but it is the
intention of the parties, supported by the ~~preaentations and warrantiea of
these deponents, that the graatee ehall take unencumbered title, and there-
fore the veating of title shall not operate to effect auch a merger of interests
as to extinguish the mortgage lien if such extinguishment might serve to pro-
mote the priority of any subordinate intereste which may be outatanding at
the time of such vesting of title. -
This affidavit ia made for the protection and tienefit of the aforesaid
Firet Federal, its successors and asaigna, and all other parties hereafter
dealing with or who may acquire suy intereat in the property deacribed in
the aforesaid deed, and shall bind the reapective heira, executors, adminis- •
trators and assigna of the undersigned.
