ing and deliv~ring simultaneously to MARAVILLA DEVSLOPMENT COR-
PORATION a promissory note in the amount of $188,000.00, se- _
cured by a purchase money mortgage encumbering said lands as re-
corded in O.R. Book 74, at pages 617 through 623, of the public
records of St. Zucie County, Florida: and ~
WHEREAS. MARAVILI~A DEVELOPMENT a -
ecuted and delivered to INDIAN RIVER MINERALS, INC., in accord-
ance with the provisions of said mortgage, three (3) partial re-
leases of parcels of said lands, recorded in O.R. Book 74, at
pages 570-571, O.R. Book 145, at pages 350-351, and O.R. Book
145, at pages 352-353, of the public records of St. Lucie
County, Florida; and
WI~REAS, INDIAN RIVER MINERAIS-: INC., executed and de-
livered to ~ B~ARNETT FIRST NATIONAL BANK OF JAQCSONVILLE its
promissory note in the arnount of $180,000.00 and a second mort-
gage enewnbering, among otYier lands, said lands purchased from
MARAVILLA DEVELOPMENT CORPORATION, as recorded in O.R. Book 87,
i at pages 208-211, of the public records of St. Lucie County,

~ W~REASs INDIAN RIVER MINERALS, INC., being in default
upon payments to MARAVILLA DEVELOPMENT CORPORATION under its
said note, dated November 8, 1963, as secured by said purchase

•money mortgage, filed a suit to foreclose said mortgage in the
Circuit Court of the Nineteenth Judicial Circuit of Florida, in ;
and for St. Lucie County, Case No. 68-82, on the 30th day of ~

~ January, 1968, said suit being presently pending upon the date
~
~ of this Agreement; and
~ WI~:REAS, the parties hereto, in order to expedite,

facilitate and permit the performance by INDIAN RIVER MINERALS,
