channel to the Inland Waterway also shown on Schedule l, free
and clear of all liens and ecumbrances other than a certain ex-
isting mortgage lien held by DOROTHY SCHOENITH McMILI.AN, which i
the only existing lien against said real pro~erty other than an

VILI.E shall release and remove any mortgage lien or other lien
which it may have against said real property at that time. In
the event that said real property is so transferred by good and
sufficient deed to UNITED STATES STEEL CORPORATION, INDIAN RIVSR
MINERAIS, INC., and the UNITSD STATSS STSEL CORPORATION shall

share in the cost of maintaining the channel to the Inland Water
way ~n proportion to their use of the channel, calculated upon
tonnage shipped. •
11. Upon the coinpletion and accomplishment of all cov-
enants, agreements and undertakings hereinabove set forth, the
above-mentioned contract between BAF~AM~ (~MENT CONipANy and INDI
RIVER MINERALS, INC., dated Novea?l~er 20, 1963, shall terminate
and all obligations of BAFiAMA C~EMENT CQMPANY and INDIAN RIVER
MINERAIS, INC., thereunder shall be deemed to have been fully
, discharged.
12. This Agreement shall be construed and applied ac-
cording to the laws o£ Florida.
13. This Agreement is executed in five (5) counter-
parts, any one of which shall be deemed to be the original, al- :

14. AlI notices, demands and other requests to be sent
to any of the parties hereto, pursuant to or necessitated by the x
