IT IS AGREED that the pipeline or pipelines to be laid under this grant shall be lowered in depth by Grantee in the eveat that a spur railroad track, road or highway-is constructed upon said abave described prennises. ~ The Grantor agrees not to build, construct or create, or permit others to build, construct or create any buildings or other structures within ten (10) feet~on each side of the pipeline or ~ pipelines to be coastructed upan the above described premiaes, sub- - ject to the rights herein granted.
