and other valuable conaiderations, in hand paid, receipt and
sufficiency of which is hereby acknawledged, I, WILLIAM G. TYS, a
m~~ single adult, hereinafter referred to as "Grantor", do hereby
grant and convey unto CITY OF FORT P7~ERCE, a nnmicipal corporation

canstruct, maintain, inspect, operate, protect, repair, replace,
~ m~ change the size of, or remave a pipeline or pipelines and appur-
tenances, for the transportation of natural gas, oil, petroleum
products or any ather liquids, gases or substances which can be
= L~ transported through a pipeline; together with the right of ingress
~ and e gress to and fram the same for the purposes aforesaid, over,
under, through and across the follawing described lands, of which
the Grantor warrants he is the awner in fee simple, situate in St.

Tp gAVE AND TO HOLD SAID right of way and easement unto

IT IS AGREED that the pipeline or pipelines to be laid wader
this grant shal~ be lawered in depth by Grantee in the event that
a spur railroad track, road or hig~way is canstructed upon said
above described premises. ~
The Grantor agrees not to build, construct or create, or
peanit ~~~ers to build, construct or create any buildings or other
~ structures within ten (10) feet an each'side of the pipeline or
~ pipelines to be constructed upon the above described premises, sub-
~ ject to the rights herein granted.

~ Grantee shall dispose of trees and timber not needed for~' ~
~ construction of the pipeline by cutting tree trunks and larger limbs
in lengths of no less than 8 feet, and shall stack same along the
edge of the right of way, aad all brush, trim~ings, and stvmtps
remaved from the ditch line shall be ~iurned or disposed of in a
manner acceptable to Grantor. And payment due herevnder may be
made direct to the said Grantor. ~ . .
This easement is given with the underatanding that the
pipeline or pipelines and appurtenances ahall be confined to the
~ North 15 feet of the 50-foot wide strip of land described above.

P~rther, thia easement is made for the purpose of giving and
~ granting to the Grantee, ita successors and assigas, a right of
~ way and easement in and to said lands for tre purpoaea as set out
~ abwe, and in the event auch uae bq Graatee be diecontinued or
abandoned, the herebq granted easement shall autamatically tenninate.
