HomeMy WebLinkAbout2785 ~ t~c...~J1.~i ~-.uL...~,.~ _ . . . . , . ~ of Sectfon lf3 of Article XII of the Constitutfon of Florida that the nuriber of instruct~ion units in each of said respective Counties in each year, as long as the bonds.herein validated shall be outstandi.ng and unpaid, will not be less than the greater of (1) the number of instruction units in each of said Counties for the school fiscal year 1951-52, or (2) the numb~r of instruction units in each of said Counties for the school fiscal year fn wh3.~h any bonds or motor vehicle tax anticipation certlficates are issued on behalf of each of said Count3es pursuant to said School Capital 0utlay ~ Amendment, or (3) the number of instruction units in each of said Counties which will produce sufficient revenues in each year under said School' Capital Outlay Amendment to equal one and one-third (1 1/3) times the aggre~ate am:ount of principal of and interest on all bonds or motor veh3ele tax anticipation certificates issued on behalf of each of said Counties pursuant to said School Capital Outlay Amendment which will mature and~ become due in such year; that said covenant in said resolutions is in a11= respects legal and valid. ~ _ 7. That plaintiff has• pxovided for a form of validation certifi- ; cate to be stamped or ~~ritten on said State School Bonds substantially in - the form set out in Section ?5.lls Florida Statutes; that Section 75.11, ~ ,Florida Statutes, applies to agencies of the State of Florida and such form-of validation certificate may leg,ally and validly be affixed to said S~ate School Bonds. ~ - 8. That all of the proceeds derived from the sale of said State School Bonds to be issued for ~each of the Counties of Bay, Bradford, w Brevard, Broc,rard, Columbia, Dade, Duval, Hernando, Highlands, Hi11sU~rough, Indian River, I?sanatee, Orange, Pinellas, Putnam and St. Lucie, F•lorida, are to be expended in each of sa~.d Counties, respectively. ~ 9. That on the_ 22nd day of April , 19r-~8, the State Board adminisi;ration, a constitutional bady created by ~nd existing under Sectioz~ . 16 of .Articye IX of t~~e Constitution Florida, did pur~u~nt to the require-- me-nts of Section 215.56, Flurida Sta~utes, duly adopt a resolut3.on approvi~~ the issuance of~said $51,710,000 State School Bonds by the'State Board of Ed~~cation as to fiscal and legal sufficiency.
