The Grantor agrees not to build, con8truct or create, or
pennit others to build, canstruct or create any buildi~ngs or other
structures within ten (10) feet on each side of the pipeline or
pipelines to be constructed upon the abwe described praperty.
It is agreed that the pipeline or pipelines to be laid under
thia graat shall be constructed at sufficient depth belaw the
surface of the graund to pezmit normal cultivation, and Grantor
shall have the right to fully use and enj oy the above described
premises, subject to the rights herein granted.
Grantee shall dispoae of trees and timber not needed for
construction of the pipeline bq cutting tree trunks and larger
limbs in lengths of no less than 8 feet, and shall stack same
along the edge of the right of way, and all brush, trimmings,
and stum~ps, removed from the ditch line shall be burned or dis-
posed of in a manner acceptable to Grantor. And payment due
hereunder, if any, may be made direct to the said Grantor or
any one of them.
Further, this easement is made for the purpose of giving
and granting to the Grantee, its successors and assigas a right
of way and easement in and to said lands for the purposes set
~ out above, and in the event such use by Grantee be discontinued
or abandaned, the hereby granted easement shall automatically
terminate. -
It is understood that the person s~ecuring this grant is
without suthority fram Grantee to make any agreemenis with respect
to the sub~ect matter hereof not herein expressed.
The terms and canditions hereof shall be binding upon and
inure to the benefit of the heirs, executors, administrators,
devisees, successors, trustees or assigns of the parties hereto.
