This cause havinq come on for trial'before the Gourt
sitting without a jury arid the Court havinq considered the .
evidence and havinq heard argument of counsel for the respec-
'tive parties, and being fully advised in the premises, and
having filed herein~its findings of fact and conclusions of
law, and having directed that judgme~cit be entered in accor-

dance therewith; naw, therefore, by reason of the law and
findings aforesaid, it is • ~
- ORUSRSD, AATIJDGED AND DBCRSED as follaws: ~
1. That the Application for Coritract or Proposal
Bond arid AiGREF~NT OF INUEMNITY executed by defendants, dated ~ •
April 14, 1961, which contract is upon a printed form of ~ ~
Newark Insurance Canpany, be refon~aed so as tp conform to .

the actual contract made with reference thereto, ao that said '
contract is hereby made to read "Royal Indemnity Canpany" in- ~
stead of "Newark Insurance Canpany" wherever the words_"Newark. i

Insurance Coaapany" appear therein. '
2. That the defendants, D, H. Foster, Paul J. Kortsch, .
and Jack Y. Willian?s, and each of them, are hereby required "
specifically to perform the cov~enants and undertakings by them :
aqreed to be performed in the said AGREEMENT OF IND~MNITY for
the use and benefit of Royal Indemnity Company. ;
3. T'hat th~ defendanta, D. H. Foster, Paul J. Kortscb,
and Jack Y. Williams, jointZy and severally, forthwith pay to
