HomeMy WebLinkAbout2223 ~ r . • together with a 3/20ths interest in the pumping station located on the land heretofore described at the intersection of Orange Avenue and the 80-foot road easement, as above described; Together with a 1/3rd interest in the pumping station which is located on the West 30 feet of the South 1,000 feet of the North 3,600 feet of the West 1/4 of Secti~n 5; the aforesaid easements consisting of ditchea, dikes, canals and pumping station, are for the purpose of drainage, irrigation and water conservation purposes, and all of said easements lying in Townahip 35 South, Range 38 East, St. Lucie County, Florida, it being the intention of the Grantors to set up a 30-foot cammon easement along the West Section line of Sections 5 and 8, as above de- scribed, and along the.propertq ad3oining Orange Avenue, to be used by the property owners of property in the West 1/4 of Section S (excepting the North 1,6$9 feet thereo~) and the West 1/4 of Section 8 lying North of Orange Avenue, on a common and joint basis, except- ing the pumping station located on the West 30 feet of the South 1,000 feet of the North 3,600 feet of the West 1/4 of Section 5, which ptmnping station shall be used only for the overhead irrigation system and drainage and irrigation of lands in the South 3,000 feet of the North 4,689 feet of the West 1/4 of Section 5, as above de- scribed, and that the Grantee shall have access to all pumping sCa- tions described herein and will be responsible to pay a prorata share of the operation and maintenance of said pumping stations, drainage and irrigation canals and dikes. T'he Grantors reserve the right to grant similar easements to other parties. Together with ~oint and common use of the drainage ditch on the South line of the propertq herein conveqed and the Grantors, owning the property directly South of said ditch, do hereby reserve the right to themselves, their heirs and assigns, of use of the commnon drainage ditch located therein. This conveyance is sub3ect to a reservation unto the Grantors, their heirs and assigns, for an easement over any portion of the above de- scribed property lying within the West 30 feet of the West 1/4 of Section 5(excepting, however, the North 1,689 feet thereof), Towa- ship 35 South, Range 38 East, for the purpose of drainage, irriga- tion and water conservation purposes. Sub3ect to all easements, restrictions, reservations and dedications ~ of record. Sub3ect to zoning of St. Lucie County, Florida. 6 ~ Together with an easement over the East 40 feet of the West 1/4 of ~ Section 8 lying North of State Road 68 (Orange Avenue Extension); and over the East 40 feet of the West 1/4 (less the North 1,616 feet thereof) of Sec~ion 5, all lying in Township 35 South, Range 38 East, St. Lucie County, Florida, for general road purposes in accordance with those easements recorded in Deed Book 255, page 658, and in Of- ficial Record Book 39, page 333, public records of St. Lucie County, Florida; with the grantors reserving right to themselves, their heirs and assigns, to the free and uninterrupted use of said road for all general road purposes, as set forth in the above deeds. ~ 41 - ~ j~.
