and SECOND PARTIES in said Deed hereby agree to
assume the then existing balance of the Atico ?
Financial Corporation mortgage as of that time `
and will agree to make the payments to said
mortgage co3npany whicb.would then be SEVENTY
DOLLARS ($70.000 per month. .
SECOND PARTIES agree to pay a penalty charge of
THREE DOLLARS FIFTY CENTS ($3.50), for each month
they fail to pay FIRST PARTIES the payment by the
SEVENTH day of said month.
SECOND PARTIES agree to pay all taxes and insurance
which become due against the above property and
in the event any sum of money becomes payable by
virtue of said insurance, FIRST PARTIBS shall have
the right to receive and apply the same to the
indebtedness hereby secured should there be any
amount in excess of the amount due the first mort-
. gage holder, and F~RST PARTIES shall account to
SECOND PARTIES foi`~any surplus. SECOND PARTIES
agreed to pay all costs, charges, expenses, attorney's ~
fees, title searches and any other expenses reasonably
incurred or paid by FIRST PARTIES because of the fail-
ure of SECOND PARTIES to.promptly and fully comply
with all of the conditions of this agreement.
If any sum of money herein referred to be not promply
paid within FIFTEEN (15) DAYS after the same becomes due, or
' if any of-the agreements, conditions and covenants of this
agreement are not fully performed, complied with and abided
3y, then the entire balance of this agreement shall forthwith

~ and thereafter, at the option of F.IRST PARTIES, become due

and payable and the estate hereby created in SECOND PARTIES
shall cease, terminate and be null and void. This agreement ~

shall, at the option of FIRST PARTIES, be forfeited and term- ~
inated and the SECOND PARTIES shall forfeit all payments made
by them on this agreement and such payments shall be retained
by FIRST PARTIES in full satisfaction and liquidation of all `
~ damages by them sustained and FIRST PARTIES shall have the !

right to re-enter and take possession of the premises afore-
said without being liable for any action therefore.
