pC}R~$NT made this 9th day of December, A.D., 1968, by
and betxeen TI~ FIRST NATIOd~1AL BANK OF MIAMI, hereinafter called
the MORTI~AaSS, and INDIAN RIVSR LAND INVSSTMSNT3, INC., hereinafter
called the MORT(~A(iOR, and (}ARDNSR CO~WLSS, hereinafter called the
PURCHASSR.
WITNESSSZ'H
THAT, WH$REAS, the Mortgagor, being indebted, did make,
execute and deliver unto eaid Mortgagee its certain promissory notea
evidencing variou~ indebtednessea; and did further deliver unto
said Mortgagee certain mortgage deeds to secure said notes, which
said mortgages are filed for record in the Public Records of St.
Lucie County, Florida, and encumber the propertiea deacribed in
eaid mortgagea, a schedule of which is annexed hereto and made a
part of this Agreement as Annex l,
` AND, WHTsR$AS, Purchaser by deeds has acquired title to
the aforesaid mortgaged properties from the Mortgagor,
~ AND, WHSRSAS, it was a consideration oP the acquiaition
that the Purchaser assumes and agrees to pay the aforesaid notes
and mortgages,
AND, WHSRBAS, said Mortgagor does now deaire to be re-
leased by the Mortgagee from all Purther personal liability on
said obligations. .
Nt?W, THSR$FOR$, for and in consideration of the premiaea
and of the benePits and detriments accruing.Prom one to the other,
it is hereby agreed b3? and between the partiea hereto aa followa:
- (a) That the Purchaeer, aardner Cowlea, doea hereby ex-
pressly asaume and agree to pay the aforesaid notes and mortgagea
