~ It is further covenan~ed a~d agreed that the party oi the first part, aseignor
and hie successore or aseigns, shall have no right, power, or authority to alter~
modify or amend the terme, or any of them, of any of the leases above des-
cribed in any particular whatsoever without first obtaining the consent in writing
af FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF INDIAN RIVER
COUNTY, to such alteration, modification or ame~ulment.
Nothing herein contained shall be conatrued as making the FIRST FEDERAL
SAVINGS AND LOAN ASSOCIAZ'ION OF INDIAN RIVER COUNTY, or its aseigns
and successors, a mortgagee in possession, nor shall said Corporation, or its
ass~gns, be liable for lachea, or failure to collect said rente, iasues, profits,

revenues, royalties, rights and benefite and it ia understood that said Corporation
is to account only for such aums as are actually collected.
IT IS UNDERSTOOD AND AGREED that neither the existence of thia
aseignment nor the exercise of its privilege to collect said rents, issues, profits,
revenuea, royalties, rights and benefits hereunc~er, shall be construed as s
waiver by the party of the second part, or ita succeasors, and assigns, of the
right to enforce paymeat of the debt hereinabove mentioned in strict acoordance
~ with the terms and provisions of the mortgage and note for which this
~ aseignment is given as additional security.
