SUTNERLAND, as ~ z , Guardian of the property of A. WALTER ROI~tBACH, Incampetent, Mortgagee, Party of the Second Part, W I T N E S S E T H: WHEREAS, the Party of the-Second Part represents and warrants that he is the holder and owner of a certain promissory note and mortgage securing the same, and that the Parties of the First Part represent and warrant that they are the owners of the equity of re- ~ demption of the mortgaged premises; AND, WHEREAS, that certain mortgage securing said promissorq note described as follows: Pramissory note in the face amount of $15,000.00 executed by Evelyn F. DeKold Neville, A. Barlow Heikes, and Caroline Heikes, to John H. Sutherland, as Guardian of the Property of A. Walter Rohrbach, i Incompetent, dated February 11, 1966, a copy of which E is recorded in tha t certain mortgage dated February ~ 11, 1966, executed by the above parties to John H. ~ Sutherland, as Guardian of the Property of A. Walter Rohrbach, Incampetent, and recorded in Official Record Book 139, page 334, Public Records of St. ~ Lucie County, Florida, on February 28, 1966, which ~ said mortgage secured said promissory note; • ~ ~ ~ 1 ~ WI~REAS, the parties are desirous of a modification of the terms of payment of the promissory note contained in said mortgage.
