HomeMy WebLinkAbout1995 . ~ ~ I SEVENTEENTH: T'he Mortgagee, its successors, legal s representatives or assigns, shall and may from time to time, ; and at all timea after default shall be made in the performance f of the provisions or conditions herein contained, peaceably ~ and quietly enter into, have, hold, use, occupy, poasess and ~i enjoy all and sinqular the above granted and bargained premiaes, ~ with the appurtenances,without the let, suit, trouble, hindrance or deniaZ of the Mortgaqor or of any other person or persons ; whatsoever. EIGHTEENTH: This Mortgage is a lien upon any and all award or awards heretofare or hereafter made by any federal, state, municipal or other governmental authority, including ' any award or awards for any chanqe of grade or the widening of streets adjoining the premises, all of which awards are . hereby irrevocably assigned to the Mortgagee and the said Mortgagee is hereby authorized and empowered to collect and receive the proceeds of any such award from the authoritiea making the same and to give proper receipts and acquittances therefor and to apply the same taward the payment of the amount owing oa account of this Mortgage and the said note secured hereby, the fact that said note may not be then due and pay~ble notwithstandinq. 'The Mortgagor agrees to pay all attorney's ~ fees and expenses incurred by the Mortgagee to protect its ~ interest as Mortgagee in the event proceedings are instituted ~ to condemn the mortgaged premises in whole or in part. IJINETEENTH: Z"he tena Mortgagor and all pronouns used in connection therewith shall be construed to include the legal representatives, successors and assigns of the Mortgaqor and that the covenants and agreements of the Mortgagor shall extend to and be binding upon all said persons and shall inure to the benefit of the Mortgagee, its legal representative, successors and assigns. ~ TwENTISTH: Z'he Mortgagor shall at all times work, ; prune, cultivate, fertilize, spray, dust, care for and maintain ; in a huabandli~e manner according to the most approved methods ~ of culture, all of the grove and orchard trees now on said premises or hereafter planted thereon, and shall protect said grovea and orchards against loss or damage by fire by making and maintaining proper fire breaks in and around said groves and orchards in a good and workn?anlike manner; and in the event that the M~ortgagor shall default in the perfornwnce of any of the pravisiona of this paraqraph, the Mortgagee may, without ~ notice or demand, remedy auch default and carry out and perform all of the obligationa of the Mortgagor hereunder at the coats ' and expense of the Mortgaqor and pay the coat thereof, and the e:~~1~ r~~.~~ ~ - _ . _ -
