(4) To pey e reesonable attorney's fee in the event the first perties
or their assignees Pind it necessary to place this contrect in the
hends of an ettorney to enforce the provisions thereof by suit
or otherWise.
t5) To promptly pay each and every the installments of principel an d
interest as hereinbefore re-quired prornptly es the same becomes due.
Time of such payments being the esaential pert of this agreement.
(6) The perties of the second part covenant and egree that in the event
any paynent due hereunder shall become delinquent for thirty days,
that the perties of the first part shall be entitled to the
appointinent of e receiver to take and possess the property above
described and to cause the removal of the second parties or any
parties claiming under them, Which receiver shsll conserve the seid
property an d the rents and profits arising therefrom~until d~scharged
by the c ourt of complete ~urisdiction.
IN~ow, if the parties of the second part shall meke the payments
and perform the coveneo ts hereinbefore mentioned on their pert to
be performed, then the party of the first part will i'orthwith tender
a good and sufficient Deed with Documentary stamps affiaed then in
a proper amount to the seid perties of the second pert.
In the event of failure of the said parties of the second part
to make any of the paylnent, or any part thereof or fail to perPorm
any of the covenants on their part, hereby make end entered into
in a ddition to the remedies hereinbefore accorded to the first parties~
this contract shall, at the option of the parties of the first part,
be forfeited and termineted, and the parties of the second part shall
- forfeit all payments made by them under this contract: and such
payments shall be retained by the said parties of the first pert in
full satisfaction and liquidation of all dameges by them sustained,
and the said parties of the first part shall have the right to re-
enter and take possession Bf the premises aforesaid Without being
liable to any action therefor.
The making of payments anticipated hereinbefore provided shell not
extend the time of the next due payment.
IT IS MUTTIALLY AGREED, by and between the parties hereto, that the
~ time oi' each payment shall be essentiel part of this contract and
~ that all covenan ts and agreements therein contained shall eatend to
~ and be obligatory upon the heirs, executors, administrators and
~ assigns of res~ective pPrties.
I'1' IS ~[?RTHFR AGREF~D that the title to the personel property here-
inbefore enumerated shall_remain on the premises until~eachange
or renewal is authorized in Frriting by said parties.
