5. That thie agreement maq be recorded in the racords of
the Clerk of the Circuit Court of the county Wherein the parties
may henceforth reside and in turn,the said agreament may ba offere
for probate aa a Will of the person:.first expixing and herein shal
ope rate to transfer to the peraon aurviving, any and all rigt~, ~
title and interest, the f irat expiring person ehall have and hold
at the time of death.
6. That notwithstanding the foregoing and well knowing
the right of a party to change their mind or position or condition
in ordinary mattere, each partr here covenants and agrees that
this survivorship ~~eement shall continue on and ehall be the
Last W ill and Testament of the party first expiring not~ithstandin
subsequent writings and that in addition to being a Will, the
conditions herein shall be and are enforceably covenants against
any and all parties whateoever claianing adverse thereto.
IN WITNFSS WHEREOF, tke ve said artie have hereunto
