THIS INDENTURE, Made this the day of April, A.D. 1969, .
between KIMCO FT. PIERCE, INC., a Florida corporation, party of
the first part, and CITY OF FORT PIERCE, a municfpal corporation
of the State of Florida, party of the second part,
WITNESSETH: That the said party of the first part, for and
_ in consideration of the Sum of One Dollar ($1.00) and other _
valuable considerations to it in hand paid by the party of the
_ second part, the receipt whereof is hereby acknowledged, has
granted, bargained and conveyed, and by these presents does
grant bargain and convey to the said party of the second part,
its successors and assigns, for such period of time as said -
' party of the second part may require the use of the following '
described land, or until the use thereof is abandoned by the
party of the second part, a non-exclusfve easement over, upon and

in red on Exhibit A attached hereto and by this reference made
a part hereof, and being more particularly described as follows:

utilities purposes; and the said party of the first part do~s

TO HAVE AND TO HOLD the same unto the second party, its
