THIS AGREEMENT made and entered into this ~lO~dey of
April, A.D., ~969, by and betNeen RAY D. JOHIdSON, JR., of Fort
Pierce, Florida, hereinafter referred to as RAY, MARILYNN
LORRAINE JOHI+i30N, of Portland, Oregon, hereinaPter referred to sa
MARILYNN, J. FRANK BROOME, hereinafter referred to as FRA2tK, and
MARY ELIZAB~ETH BROOME, his Kife, hereinaYter referred to as
ELIZABETH, of Fort Pierce, Florida, sometimes hereinafter also
referred to as BROOMES;
WITNESSETH: '
W~~REAS, RAY and MARILYNN heretoYore entered into a
Child Custody and Property Settlement Agreement, dated December 28,
1967, copy of which is recorded in O.R. Book 170, page ~9~6, of the
public records of St. Lucie County, Florida; and '
WHEREAS, RAY heretoYore made, executed end delivered to
MARII,YNN a promissory note in the amount of $90,000.00, dated January

~ 2, ~968, secured b}~ mortgage a~ea oY even date therewith, recorded
! in O.R. Book 170, page 1238, of the public records of St. Lucie
~ County, Florida; and

~REAS, RAY and FRANR, as Co-partnera, were the owners
and holders oY a promiasory note dated April 21, 1967, msde, executed

and delivered by Wesley Harvey, et el, secured by mortgage deed, re- '

corded in O.R. Book 103, page 435, of the puDlic records oY Okeechobee
Co~ty, Florida, and RAY, on January 2, 1968, pursuent to said
~ Property Settleaent Agreement, negotiated hia intereat in seid
promissory note end essigned hia ixiterest in said mortgege to Robert
B.Butler,as Trustee, Nhfch asai~ent is recorded in O.R. Book 106,
page 471, oi the public records o! Okeechobee County,Floride; and ~
