For value received, I or we, jointly and severally, promise to pay to the
order of FLORIDA ULTRA FLO INC. at 328 South Second Street, Ft. Pierce, Fla.
Fourteen thoueand fovr hundred twenty-s ix and no/100 DOLI.ARS
in the manner following: One payment on or before six months after date
in a sum equal to the proceeds from the~first crop, the crop presently on
the trees, ~less the amount necessary to pay 1968 taxes;
The balance shall be payable within one year together with interest at six
percent per annum until paid with the further provision:
1. For good cause shown and upon givi.n~ thirty days notice together
with interest to date and a payment of the minimum of 33 percent of the
amount due, the promisor may defer payment of the remain ing.unpaid balance
for an add itional twelve months' period, all sums payable with sevea percent
per annum on the unpaid balance and further provided;
2. That no default shall be taken against the mortgagors in any year
wherein at least one-third of the unpaid principal herein has been gaid
(said one-third shall not include the proceeds from the first crop as above
provided) and further;
3. No default shall be taken herein in any ear wherein the proceeds
of the fruit crop (less only the cost for pic~~g~ shall be less than the
I installment in arrears provided the said proceeds shall be applied against
' the sums owed hereunder. -
~ 4. All sums deferred and unpaid in excess of two years shall bear
interest at the rate of 72 percent per annum.
If any ins tallmen ~ of .,,this note is not paid at the ti.me and place
specified, the entire amount unpaid shall be due and paqable at the election
of the ho~der hereof. All parties hereto, whether makers, endorsers,
sureties, guarantors, or otherwise, hereby waive demand, notice and protest.
If placed in the hands of an attorney for collection, we jointly and severally
agree to pay reasonable attorney's fees in the minimum amount of $300.00
or as may be adjudged, whichever is the greater.
It is agreed that except for sums paid to 1968 taxes, all sums herein-
after paid shall be paid one-third to Stop, Inc. and two-thirds to the
mortgagee until said Stop, Inc. shall have been paid $5,250.00 plus interest
sales commission which said commission is restricted to and payable from
proceeds of this note.
