HomeMy WebLinkAbout0936 . ~ - 8 - (a) Failure to pay the amount of any installment of prin- cipal and interest, or other charges payable on the Note, which shall have become due, prior to the due date of the next such installment; (b) Nonperformance by the Mortgagor of any covenant, agree- ment, term or condition of this Mortgage, or of the ~ Note (except as otherwise provided in subdivisi~n (a) hereof) or of any other agreement heretofore, herewith or hereaf~er made by the Mortgagor with the Mcrtgagee in connection with such indebtedness, after the Mort- gagor h~s been given due notice by the Mortgagee of such nonperformance; (c) Fai~ure of the Mortgagor to perform any covenant, , agreement, term or condition in any instrument creating a lien upon the mortgaged property, or any part thereof, . wnich shall have priority over the lien of this Mortgage; (d) ^::e Mortgagee's discovery of the Mortga~ar's failure ~~n any application of the Mortgagor to the Mortgagee ~o disclose any fact deemed by the Mortgagee to be ma~erial, or of the making therein, or in any of the agreements entered into by the Mortgagor with the Aiortgagee (including, but not limited to, the Note and this Mortgage) of any misrepresentation by, on behalf • of, or for the benefit of, the Mortgagor; ' (e) The sale, lease or other transfer of any kind or nature o~ the mortgaged p-~~operty, or any part therof, without . tre prior written consent of the Mortgagee; _ The Mortgagee's failure to exercise any of its rights hereun3er shall not constitute a waiver thereof. All the events in this . Paragraph enumerated upon the happening of any of which the Note shall become, or may be declared to be, immediately due and payable, are in this Morzgage called "events of default". 12.
