RESOLUTION NO. 68-2 BE IT RESOL%"~D by the Board of Commissioners of the Fort Pierce Port and Airport Authority in special meeting assembled this 6th day of February, 1968 that the Chairman and Secretary of said Authority are hereby authorized and directed to exe- cute the Subordination Agreement to the First Federal Savings and Loan Association of Fort Pierce and the Citizens Federal Savings and Loan Association of St. Lucia County, a copy of which is attached hereto and by reference made a part hereof. RESO~UTIO~ PO. 68-3 WHEREAS, Section 116.34, Florida Statutes, provides that any authorized officer, after filing with the Secretary of State his manual signature certified by him under oath, may execute or cause to be executed with a facsimile signature in lieu of his manual signature any public security or instrument of conveyance, pro- vided that at least one signature required or permitted to be placed thereon shall be manually subscribed; any instrument of payment; or any official order, proclamation or resolution, and WHEREAS, MARJORIE B. S of the Fort Pierce Port and Airport Authority RESOLUTION NO. 68-4 WHEREAS, the FORT PIERCE PORT AND AIRPORT AUTHORITY owns approximately 26 acres of land on the South Causeway at Fort Pierce, St. Lucie County, Florida. and approximately 15 acres of submerged lands on the North side of said Causeway. and WHEREAS, the title to said lands is subject to a provision in the deeds from the Trustees of tbs Internal Improvement Fu~d that it shall be used for "public purposes" and for "causeway and harbor improvements", and WHEREAS, in order to properly develop said area the Port and Airport Authority has had a plan prepared by the Regional Planning Council of St. Lucie County, a copy Of which is attached hereto and by reference made a part hereof, which plan has also been approved by the Port and Airport Authority. the County Planning Board and the City of Fort Pierce Planning Board. and WHEREAS, the Port and Airport Authority desires that the deed restrictions be refined or amended so as to permit the use of said lands for the purposes set forth in said development plan without violating the public purpose restriction contained in the deeds from the Trustees of the Internal Imppovement Fund. Secre~ry~of the Fort Pierce Port and Airport Authority RESOLUTION NO. 68-5 WHEREAS, the Fort Pierce Port and Airport Authority, the owner of the St. Lucie County Airport including the Airport In- dustrial Park, Unit 1, as recorded in Plat Book 12, at page 40 of the public records of St. Lucie County, Florida, desires to sell or lease lots in said Industrial Park to private individ- uals and corporations for industrial development, and WHEREAS, in order to do so it is necessary that a deed of release be secured from the Federal Aviation Administration. NOW, THEREFORE, BE IT RES~VEDby the Board of Commissioners of the Fort Pierce Port and Airport Authority in meeting assembled this 14th day of May, 1968, as follows~ 1. That said Authority does hereby request a deed of release from the Federal Aviation Administration to the following described lands in St. Lucie County, Florida, to-wit~ Airport Industrial Park, Unit 1, as recorded in Plat Book 12, at page 40 of the p~blic records of St. Lucie County, Florida. 2. That all sales or leases of the above described lands shall be subject to the following conditions, (a) The Fort Pierce Port and Airport Authority reserves for itself, its successors and assigns, for the use and benefit of the public, a right of flight for the passage of aircraft in the airspace above the surface of said lands, together with the right to cause in said air- space such noise as may be inherent in the operation of aircraft now known, or hereafter used~ for navigation of or flight in the air, using said airspace for landing at, ~ . taking off from or operating on the St. Lucie County Air- port. (b) No use shall be made of sa~d lands which would interfere with the aeronautical use of the St. Lucie County Airport. (c) No buildings or construction shall be erected to more than 100 feet above ground and all such buildings or construction shall be subject to the approval of FAA Form 117, "Notice of Proposed Construction or Al- teration''. 3. That a certified copy of this resolution be for- warded to Federal Aviation Administration, Miami Area Office, P. O. Box 2014, AMF Branch, Miami, Florida 33159. STATE OF FLORIDA COUNTY OF ST.
