and understood that Seller shall not be liable for
any damages whatsoever in the event Seller is un-
able, for any reason whatsoever, to deliver title
to Buyer for any of the tracts in accordance with
the foregoinq_provisions, but Buyer shall have
the right to bring an action for specific perform-
ance under this option. In the event Buyer does
not bring an action for specific performance,
Seller's only obligation shall be to return any
security money deposits or earnest money deposits
which it is holding.
5. Buyer shall have no right to exercise any
options granted hereunder at any time at
which there exists a default in any of the terms
and provisions of the aforesaid lease, unless
Seller elects to waive this provision. This Agree-
ment may be recorded. Seller and the sole benefi-
ciary agree that they will not, without the consent
of the Buyer, place any mortgage lien against the
premises which cannot be removed by Seller at the
time of the exercise of any of the options here-
under and to remove each such mortgage at the
time of the exercise of any of the options hereunder.
