foregoing, and all and singular the tenements, hereditamanis and appurtenances
thereto belonging, and the rants, issues apd profits thereof, and also all the
estate, right, title, interest, homestead, dower, separate estate,-possession,
claim and demand Whatsoever, as well in law as is equity, of the said Mortgagor
in and to the mortgaged property and every part thereof with the appurtenances,
specifically including all rights and equities of redemption, all of Which are
hereby expressly Waived. (All of the foregoing, whether caisisting entirely of
real property or entirely of chattels, or of both real property and chattels,
is heroin for convenience called the 'mortgaged property").
TO NAVE ANO TO HOLD the said mortgaged property and every part thereof
unto the Mortgagee forever.
PSOVIDSD A1J~lAYS, and this mortgage is on the express condition, that if
the Mortgagor shall pay or cause to be paid all of the moa~eys mentioned in said
-'Obligation" and the interest thereon, all at the times and is tho manner as
therein agreed to be paid, according to the true intent and meaning thereof,
end shall pay all other sums provided to be paid by this mortgage, and shall
perform and abide by all the covenants and agreements herein and in said
"Obligation" contained, then these presents shall be void and the estate here-
in and hereby granted shall cease and determine.
AND SAID MOEtTC.lIiGOR does hereby covenant with the Mortgagee that said
Mortgagor, at the time of e~oecution and delivery of these presents, is the
absolute owner of and in pas session of said mortgaged property; that he has
a good right, full power and lawful authority to convey the same in the manner
and form herein set forth; that said property is free and clear of all liens
of whatever nature, except as specifically mentioned herein, and Mortgagor
fully warrants the title to said property and will defend the same against all
lawful claims and demands e~ocept from the warranties contained in the encuta-
bravoes herein specifically :set forth.: - .. ~ ~ -
AND THS M~TGAGOB does hereby further covenant, promise and agree with
the Mortgagee, its successors and assigns, as follow:
1. Mortgagor will not cocmit any waste, or weaken or impair the secu-
rity of this mortgagee; will pay, prior to delinquency, all ta~oes and aasessmcn~p
levied or imposed on said property; wYll beep the mortgaged property insured
in s>aoh manner and in such mmounts as~Mortgagee way require; and will not
remove any chattels,; if included in this mortgage, frog the premises where they
are now situated, without Mortgagee's written consent.
2. I1n the event of suit to foreclose this mortgage, Mortgagee shall be
entitled, as a matter of right, without regard to the value of the mortgaged
property or to the solvency of Mortgagor, and without notice, to the appoint-
ment of a Receiver of the mortgaged property and the income and profits
thereof.
3. In the event of Mortgagor's failure to pay ta~oes, or to keep the
premises insured as required, t~rtgagee may, at its option, but is not required
to;~make such payments, and the sums so advanced shill be repaid by Mortgagor
with interest as provided in the "Obligation", and said sums so paid by the
Mortgagee shall be secured by this mortgage.
4. In the event of any default 'in the terms of the "obligation" or this
mortgage, Mortgagee nay, at eta option, declare the whole indebtedness secured
thereby to be imDediately due and payable. ,
5. That no extension of modification of the payments to bo rands as
hereinabove set forth, and no release of any part or parts of the mortgaged
property, or of other collateral securing the above described indebtedness, -
even though cmde without consent of the Mortgagor, shall release, relieve, or
discharge the Mortgagor frog the~paynent of any suns hereby secured, and
Mortgagee shall have the right to release from the lien hereof any portion or
portions of the -mortgaged property, or other collateral held as security for
said indebtedness, irrespective of tha value of the released portion, without
affecting the lien hereof as to-the portion ot•pnstions,aot reLeaaed, notaith-
standing the fact that such-seleaso or releases my be Dade without knowledge
or consent of thct Mortgagor, or of any (bcantee or Qcantees of portions of such
property theretofore sold.
6. This mortgage ony be foreclosed by the mortgagee in accordance with
nether State or Federal law in force at the brae such forecelosyurQ is insti•
