E A S E M E N T
THIS INDENTURE executed this ~rday of _,~~ •
1969, by INDIAN RIVER FOODS, INC., first party, to CARL PAUL WILD,
and SELMA R. WILD, his wife, whose poet office address is Route 4,
Box 27, Fort Pierce, Florida, 33450, second party:
WITNESSETH, that the said first party, for and in consideration
of the sum of $10.00 in hand paid by the second party, the receipt
whereof is hereby acknowledged, does hereby give, grant and convey
to second party, their heirs and assigns, a right of way and easement,
in common with first party, to maintain and use an existing rail-
road spur track presently located upon the first party's land in
St. Lucie County, Florida described as:
The S~ of the SE's of SW~ of Section_29,
Township 35 South, Range 40 East.
The term of said easement shall be perpetual, provided however,
at any time after five (5) years from the date hereof, first party
may terminate this easement by giving to second party and their
assigns of record a written notice of such termination; provided
that the first party shall concurrently therewith execute and
deliver to second party, their heirs and assigns, a grant and
conveyance of a substitute easement for like purposes over and across
a strip of land sixty (60) feet in width, to which the first party
has good and marketable title, situate adjacent to, contiguous to
and parallel with the south right of way line of the FEC Railroad
and commencing at the northwest corner of the parcel of land here-
inafter described and extending easterly parallel with and adjacent
to said railroad right of way to the west right of way of North St.
Lucie River Drainage District Canal #29, said tract of land being
described as:
Begin at the SW corner of tract presently owned by
Indian River Foods, Inc., the same being the North 222.51
_ feet of the West 450 feet of the S~ of the SEA of the SW~
of Section 29, Township 35 South, Range 40 East, run
thence West on an extensi.an of the South line to tract
owned by Indian River Foods, Inc. 300 feet to a point,
