1. This agreement is made in consideration of one of the two methods of payment as follows:
(a) cash in hand paid, receipt of which is herby sclmowledged by the FIRST PARTY, or
(b)~•~per ton for each ton of wood removed by HERCULES from above land, settlement to be made monthly
following removal
2. The FIRST PARTY e~reasly warrants and rantees to HERCULES that there are no other lessen or agreements out
standing against said wood, that he has a ,clear and n aencnmbered title to said wood and that be hsa the right to sell
acid wood and receive the consideration erefor.
a. This agree t shall remain in effect until all the acceptable wood has been removed, but in no event longer than~th~e •-~3
years from date.
