. AGREEMENT TO SELL
This agreement entered unto this 27th day of September,
1969, by and between Bertha Russakis and Ernie A. Russakis `
d/b/a Russakis Liquors a/k/a Russakis Package Store located
at 112 Depot Drive, Fort Pierce, Florida, hereinafter called
Seller, and Barbara A. Chevalier, hereinafter called Buyer.
WITNESSETH:
Whereas, Seller is owner and holder of certain
second mo~tgage covering the premises known as Russakis Liquors ~
described as follows:
North Half of Lots 8 and 9, Block H, Aaron I,ee's Map
~ of Fort Pierce, as per plat thQreof recorded in Plat
Book 1, page 189, public records of St. Lucie County,
Florida; also described as: the North half of Lots
8 and 9 of the re-subdivisiofl of Block H of the map
of Fort Pierce, Florida, as per plat on file in Plat
Book 1, at page 188, of.the public records of St.
Lucie County, Florida. -
Said mortgage recorded in OR Book 168, Pages 2869,
2870 and 2871, St. Lucie County, Florida, Public
Records and

Whereas, Seller is owner and holdex of.an Alcoholic .
~ Beverage License for sale of liquor issued by the Florida `
State Alcoholic Beverage Commission and presently used as the
premises license in and for Russakis I.iquors and
Whereas, the above referenced mortgage held by Seller
is in arrears and default, creating the necessity by Seller,
of foreclosure against Ernie A. Russakis and Jacqueline Russakis,
Mortgagors, and
Whereas, Seller agrees to sell, following foreclosure
~ and acquisition of foreclosure title, unto Buyer in accordance

~ with the hereinafter terms and conditions, now it is therefore
~ agreed as follows:
1. Seller will exercise due diligence in prosecut- ~
ing foreclosure in the above referenced mortgage covering the
subject premises and, upon obtaining foreclosure title, agrees
to sell unto Buyer that certain business known as Russakis
