BEFORE ME, the undersigneci authority, personall y appeared
FIAYD C~ WELCH and EVELYN MAE WELCH, his wife, each of whom
upon first being duly sworn, did depose and say that they are the owners
in fee simple of the above described real property; that they are aware
that A. C. Herring and Doris W. Herring, his wife, executed a mortgage
purporting to encumber the above described real property for $18, 800.00
to First Federal SavingG and Loan Association of Fort Pierce on July 29,
1969, which mortgage is recorded in O. R. Book 179, at page 782 of ~he
public records of St. Lucie County, Florida, the proceeds of which, with
, other funds of mortgagors, were intended for the purchase from these
! affiants of said real property; that said mortgage loan was never disbursed

~ by the rnortgagee as evidenced by satisfaction of said martgage executed

~ These affiants further say that before the contemplated purchase-
sale could be consummated Mr. and Mrs. Herring ascertained that they

~ would not be able to remain in Fort Pierce for which reason they would t

~ not and did not consummate the negotiations. Each of these affiants do
~ say that no consideration of any kind or nature ever passed from the Herrings
~
- to these affiants, and that these affiants have never signed their names ±o any
form of writing which might serve to vest any right, title or interest, legal
~
