HomeMy WebLinkAbout0591 ~ ~ ~ O~l. ~ 1 i SUBORDINATION OF AGREEMENT " KNOW ALL MEN BY THESE PRESENTS THAT: WHSREAS, BLUE GOOSE GROWSRS, INC., a Delaware corporation, hereinafter referred to as "Blue Goose", and LAWRENCE A. MUCKENTHALER and NELLIS MUCKENTHALER, his wife, hereafter referred to as "Mortgagor", have heretofore entered into an Agreement dated July 26, 1963, and recorded in Official Records Book 71, Page 312, Public Records of St. Lucie County, Florida; and WHEREAS, the hereinabove described Agreement grants unto Blue Goose a Zien on the real property described in Appendix "A" which is attached hereto and made a part hereof for all purposes; : ~ and WHEREAS, the hereinabove described Agreement provides among other things that there shall be no encumbrances, liens or other claims against the crops now growing or hereinafter growing on the real property described in Appendix "A"; and ~ WHEREAS, Mortgagor has applied ta The Mutual Life Insurance f ~ Company of New York, a New York corporation, hereinafter referred to as MONY, for a mortgage loan on the real property described in ~ Appendix "A", in the original principal amount of $150,000.00 { ~ which mortgage is dated November 6, 1969 and recorded iw aR.4..~~ ~ t/ r s jL, : under Clerk's No. ?~j`O,Z~ , Public Records of St. Lucie ' County, Florida, and t WHEREAS, MONY required that the lien of its mortgage be a first lien on the real property described in Appendix "A" and has requested Blue Goose to subordinate the terms and provisions ~ ~ of the Agreement hereinabove described, including specifically ~ ~ but not limited to those certain terms and provisions which, respec- ~ tively, therein grant a lien on the real property described in f Appendix "A" and prohibit encumbrances, liens or claims of liens ~ ~ against the crops now growing or hereinafter growing on said " S INSTRUMENT 1MAS~tEPJ1RED eY s-, x,c~/ 7~ • I~ AND SHOUlO BE RETURNED TO ANDERSON & RUSF3 600K ~~~,''PAGf ~ Attorneys ot t~w ~ P. 0.
