HomeMy WebLinkAbout2812 3 Sach installment shall first be applied on ~ the payment of interest, taxes and insurance ~ and then on the unpaid balance of the prin- ~ cipal sum. ~he monthly installmants wi.ll ' remain at $85.00 per month unless taxes or insurance cause the payments to fluctuate, and both parties hereto agree that if such ~ fluctuation occurs, that the monthly pay- ~ ments will be adjusted accordingly. Further- more, if the payments are not rece~ved by First Parties by the 7th day of each month, a penalty charge of $3.50 will be made. First Parties agree to give Second Parties an annual statement, no later than February 15 of each year, showing the amount credited to principal, to interest, to taxes and in- surance, from payments made during the previous caiendar year. Second Parties agree to pay all costs connected with the recording of this Agreement, which is to be recorded no later than December 31, 1969, in order for Second Parties to be ~ 1 entitled to receive homestead exemption in the coming year, ~ to keep the real estate taxes to a minimum. First Parties agree to utilize so murh of the $85.00 monthly paym~nts as is necessary to pay the real estate taxes and the insurance on said property. ~ Second Parties further agrae to pay all costs, charges and expenses, including attorneys' fees and title searches, reasonably incurred or paid by First Parties because of fail- ure of Second Parties to promptly and fully comply with all conditions and covenants of this Agreement. In the event { Second Parties fail to pay when due any sums of cnoney payable ~ by virtue of this Agreement, withiri•fifteen (15) days next after the same becomes due, or if each and every agreement, stipulation, condition and covenant of this Agreement are not fully performed, complied with and abided by, then the entire unpaid balance of this Agreement shall forthwith and u?w o~cecs WlLLES.
