rent remains unpzid £or a period of twenty (20) days a£ter
final d~terinination, by agreement or litigation, that the ~
application of the rentals was improper.
3. At his own expense Lessee shall keep the
premises in good condition and keep Lessor's improvements
and equipment in good repair. Lessee will upon the expir-
ation or termination o£ this Lease Yor any reason deliver
up said premises and property to Lessor in as good condi-
tion as when received by Lessee, depreciation due to a
reasonable use thereof £or the purposes authori2ed by this
Lease, and loss from fire, explosion and the elements or
causes beyond the control of the Lessee, excepted.
4. Lessee shall have the right to install such
pumps, underground tanks, machinery, apparatus and equipment
as may be deemed necessary in the conduct and carrying on
of the business on said premises. All Lessee's pumps,
underground tanks, machinery, apparatus and equipment,
shall be and remain the property of the Lessee, with the
right, at its option, at any time before the expiration or
termination of this Lease, and for a period of 30 days
thereafter, to remove the same, providing Lessee restores
the premises to its original condition.
5. Lessor shall pay all taxes and assessments,
general and special, upon the leased premises and property
and Lessee sha Ll pay all taxes and assessments upon machin-
ery, appartus and equipment owned by Lessee and located on~
said premises. Upon Lessee's written request, Lessor.will
furnish Lessee annually official tax receipts or true
copies thereof showing payment before delinquency of all
taxes and assessments levied on the leased premises and
property.
. 6. Lessor hereby warrants and agrees to defend
the title to the leased premises and property and agrees
that Lessee shall have the right at any time to redeem for ~
Lessor, by payment, any mortgage, taxes, or other liens
thereon in the event of dePault of payment by Lessor, and
be subrogated to the rights of the holder thereof, and may
~ deduct any such paymen~s from subsequent rentals in addi-
tion to all other rights and remedies a£forded by law.

~ 7. If the use of said premises as a gasoline and
oil station or the storage or sale of gaso line, oil, or
~ oil-produets on said premises shall be-prohibited or en~oined
by lawful authority, or if all or any ma~or part of said
premises is taken in condemnation, thereby materially
affecting the operation adversely, Lessee may, at its
option, by giving to Lessor thirty (30) days' notice of its
intention to do so, terminate this I~ease upon payment of
all rentals due up to the expiration of said thirty (30)
day period.
8. Lessee covenants and agrees that it will not
~ permit any nuisance to be created, maintained, or carried
~ on upon said premises.

9. I£, at any time during the term of this Lease,
any Uuildings, improvements or equipment belonging to Lessor,
~ located upon the above described premises shall, by fire,
iy~,
or other cause, be destroyed or rendered unfit for use by
~ Lessee, Lessor shall, within one hundred twenty (120) days,
~ replace said buildings, improvements, or equipment, in a
~ condition equal to prior condition and satisfactory for use
~ by Lessee. In the event Lessor Fails to, or is unable to,
replace said buildings, improvements or equipment, Lesaee
~ May, at its option, cancel this Lease. _
