shall also include as an appurtenance belonqinq to the mortqaged
premises, all right, title, and interest of the Mortgagor in and to the
following permits and any extension or extensions thereof;
(1) Permit issued to Gene T. Dyer and Evelyn M. Dyer, his wife,
by the Board of County Convmissioners of St. Lucie County, Floridas
,(2) Permit issued to Gene T. Dyer by U. S. Engineer District
Jacksonville, Corps of Engineers, March 23, 1966, File #SAJSP
Permit (65-573) as extended by the Trustees of the Internal
Improvement Fund of the State of Florida on December 5, 1967,
under Trustees I. I. F. File ~1351-56-253.124.
(3) State Dredqe Permit #253.123-325 issued November 4, 1969~
by the Board of Trustees of the Internal Improvement Fund;
(4) Department of the Army, Corps of Engineers, SAJSP Permit
69-759, issued 29 December 1969.
all of which said permits per~kain to the construction of bulkheads,
dredging, fillinq and construction of a causeway with bridge and
culverts in the Indian River at Nettles Island, St. Lucie County,
~ Florida, the filling of Nettles Island and submerged lands adjacent
thereto, the construction of an access waterway, and~the filling of
~ certain uplands on Hutchinson Island, St. Lucie County, Florida,
and shall also include all right, title, interest and equity of the
Mortgagor in and to that certain Agreement and Supplemental Agreement
between Iowa Land and General Development Corporation, Inc., and
Norfolk Dredging Company dated August 25, 1969, as assigned to Mortgagor.
9. Mortgagor hereby warrants that it shall complete those certain
Agreements and Supplemental Agreements between Mortgagee and Norfolk
~ Dredging Company, each dated August 25, 1969', in accordance with their
terms and conditions and that any breach thereof shall constitute a
default and breach of this mortgage; and, provided further that any
sums hereafter paid by Mortgagee on said Agreement and Supplemental
Agreement of August 25, 1969, shall be secured by the lien of this
mortgage.
