The Lessee pledges with and assigns unto Lessor, ` sul~ject to the Lessor's unde rtaking to join in mortgages provided for herein, all of the rents, issues and profits which might otherwise accrue to the Lessee, for the use, enjoyment and operation of the demised premises, and in connection with such pledging of the rents, the Lessee covenants and agrees with the Lessor that if the Lessor, i upon the default of the Lessee, elects to file a suit to ~ enforce or cancel the lease and Arotect the Lessor's right j thereunder, then the Lessor may, as ancillary to such suit, apply to any court having jurisdiction thereof for the appoint- ment of a Receiver of all and singular the demised pre- mises, the improvements and buildings located thereon, and the furniture, furnishings, fixtures and equipment con- tained therein; and thereupon it is expressly covenanted ; and agreed that the court sha12 forthwith appoint a Re- ~ ceiver with the usual powers and duties of Receive~s in like cases, and such appointment shall be made by such court as a matter of strict right to the Lessor and without re- ~ ference to the adequacy or inadequacy of the value of the S i ~ property which is subject to the landlord's lien or to the ~ ~ solvency or insolvency of the Lessee and without reference ~ to the commission of waste. XV. ; , _ LESSEE'S DUTY TO KEEP PREMISES IN GOOD REPAIR i ~ The Lessee covenants and agrees with the Lessor that a ~ ~ during the continuance of this lease, the Lessee will keep ~ ~ ; ~ in good state of repair and in first class condition any and ~ all buildings constructed and all furnishings brought or ~ placed upon the demised premises; nor will the Lessee suffer or permit any strip, waste or neglect of any building or personal property to be committed; and the Lessee will ~_a~ .
